Although kratom is technically legal in the state of Mississippi, you are unlikely to find too many areas where you can get away with selling it or using it. As of this writing, there are more than 30 counties and towns where kratom has been outlawed.
In 2018, a statute was proposed that would have banned kratom in the state, but this piece of legislation failed to pass committee. If the bill had succeeded, kratom’s chief alkaloids—mitragynine and 7-hydroxymitragynine—would have been verboten in any form.
This would have spelled the end for many area smoke shops that regularly stock kratom extracts and enhanced kratom capsules. Fortunately, cooler heads prevailed and the bill was amended to exclude the Mitragyna speciosa plant and its indole alkaloids.
In the wake of the bill’s failure, county officials took it upon themselves to impose restrictions on kratom legality. One by one, 33 counties and cities enforced a kratom ban in their respective pockets of the state.
Columbus City and Union County were the first to impose their will on local residents, effectively outlawing kratom and erroneously classifying the Ayurvedic herb as a synthetic substance. This is misleading since kratom in its natural form is the farthest thing from synthetic.
In March of 2019, Caledonia criminalized Mitragyna speciosa which set off a domino effect in the state. Within a week, five counties and at least one other town followed suit. This was unfortunate for the residents of places like Alcorn County where opioid abuse is on the rise and kratom was considered a life saver by many citizens who were attempting to kick the habit.
You may be thinking, “As long as I stay away from areas where kratom is illegal, I should be alright.” Well, slow your roll, pal! The fight to outlaw kratom is one that is still ongoing.
Senator Charles Younger has thrown his support behind a statute that seeks to codify kratom as a Schedule I controlled substance. This legislation was introduced in January of this year and may gain momentum in the months ahead.
In the meantime, it is of paramount importance that kratom users keep themselves abreast of local developments and familiarize themselves with where the herb has been banned.
